Announcement on redistribution of import tariff quota for agricultural products in 2010


According to the Interim Measures for the administration of import tariff quota of agricultural products (Ministry of Commerce, State Development and Reform Commission Decree No. fourth of 2003, hereinafter referred to as the Interim Measures), the quota of import tariff quotas for grain and cotton imports, the application conditions and distribution principles in 2010 (National Development and Reform Commission Announcement No. twelfth 2009, hereinafter referred to as the "distribution principle"), and the relevant provisions of the 2010 application and distribution rules of sugar import tariff quotas (Ministry of Commerce Announcement No. seventy-first 2009, hereinafter referred to as the "rules for distribution"), the relevant matters concerning the re distribution of agricultural products import tariff quota are hereby announced as follows:


1. The final user who holds import tariff quotas for wheat, corn, rice and rice, sugar and cotton in 2010 will not enter into import contracts or import contracts on the whole quota, but it is not expected to ship from the original port until the end of the year. The reform committee and the Commerce Department of the provinces (autonomous regions, municipalities directly under the central government and municipalities directly under the State Council), which are not completed or not completed before September 15th, should be developed.

The national development and Reform Commission and the Ministry of Commerce will redistribute the quotas returned.

The national development and Reform Commission (MDC) and the Ministry of Commerce (hereinafter referred to as the national development and Reform Commission) and the Ministry of Commerce will deduct the proportion of agricultural products import tariff quotas in the next year on the quota that the end users did not return before September 15th and did not fully use before the end of the year.


Two, obtain the final user of the import tariff quotas listed in Article 1 of this announcement, which are all used up (required to provide copies of import declaration forms), and new users who meet the application conditions listed in the "distribution principles" and "the detailed rules for distribution", but do not apply for the import tariff quota in 2010 when allocated before the beginning of the year, may apply to the development and Reform Commission and the Commerce Department of the provinces (autonomous regions, municipalities directly under the central government and cities under separate planning) to reissue the import tariff quotas for agricultural products in 2010.


Three, applicants should submit written application to the development and Reform Commission and Commerce Department of the provinces (autonomous regions, municipalities directly under the central government and municipalities directly under the central government) in from September 1st to 15th to apply for redistribution of tariff quotas.

The application format is completed in accordance with the relevant provisions of the annex "application form for the redistribution of import tariff quota of agricultural products in 2010".


Four, the provinces, autonomous regions, municipalities directly under the central government, and the departments of Commerce and development (foreign trade and economic cooperation) have made preliminary examination of the applicants' applications. In September 1st, the eligible applications were declared through the computerized tariff management system of agricultural products separately, and the applications were collected in chronological order before September 20th, and they were submitted to the national development and Reform Commission and the Ministry of Commerce respectively in written form.


Five, the national development and Reform Commission and the Ministry of Commerce will repeat the quotas submitted by users according to the order of online declaration.

The results of tariff quota redistribution will be notified to end-users by October 1st.


When the total number of eligible applications is less than the quota quota redistribution, each applicant's application can be satisfied; when the total amount of eligible applications is greater than that of the tariff quota redistribution, according to the relevant provisions of the distribution principles and the detailed rules for distribution, the redistribution is based on the principle of first come, first served.


Six, the validity period of redistribution tariff quotas and other matters shall be carried out in accordance with the interim measures, the principles of distribution and the detailed rules for distribution.


Seven, the redistribution of import tariff quotas of wheat, corn, rice and rice and cotton shall be organized and implemented by the national development and Reform Commission and the Ministry of Commerce and the development and Reform Commission of all provinces (autonomous regions, municipalities directly under the central government and cities under separate planning); the redistribution of tariff quotas for sugar imports shall be organized and implemented by the Ministry of Commerce and the Commerce Department of provinces (autonomous regions, municipalities directly under the central government and cities under separate planning).
